1. Acceptance of Terms
By accessing, registering on, or using the AlgoDelta Cloud platform ("Service") operated by AlgoDelta Solutions Private Limited ("Company", "we", "us", or "our"), registered at Rajkot 360004, Gujarat, India, you ("User", "you", or "your") agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you must not use our Service.
These Terms apply to all users of the Service, including API consumers, dashboard users, and any person accessing the platform.
2. Description of Service
AlgoDelta Cloud provides cloud server infrastructure services, including:
- Provisioning and management of IPv4 and IPv6 dedicated servers
- REST API access for programmatic creation, management, and deletion of servers
- Server monitoring and management dashboard
- Related infrastructure and support services
We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with reasonable notice to active users.
3. Account Registration & Eligibility
- You must be at least 18 years of age to create an account.
- Registration requires a valid Indian mobile number for OTP-based verification.
- You are responsible for maintaining the confidentiality of your account credentials and API keys.
- You must provide accurate and complete information during registration.
- One account per individual/entity unless explicitly approved by the Company.
- You are solely responsible for all activities that occur under your account.
4. Pricing & Payment
- IPv4 Server: ₹400 per month + 18% GST (Total: ₹472/month)
- IPv6 Server: ₹300 per month + 18% GST (Total: ₹354/month)
- All prices are quoted in Indian Rupees (INR).
- Goods and Services Tax (GST) at 18% is applicable on all transactions as per Indian tax laws.
- Payment is due at the beginning of each billing cycle (monthly).
- We accept UPI, Credit Cards, Debit Cards, Net Banking, and other payment methods available through our payment gateway.
- Failure to pay within 7 days of the due date may result in suspension or termination of your servers.
- We reserve the right to modify pricing with 30 days' advance notice to existing users.
5. API Usage & Restrictions
- API keys are confidential and must not be shared or exposed publicly.
- API rate limits may be imposed to ensure fair usage and platform stability.
- Automated scripts and applications may use the API within the defined rate limits.
- We reserve the right to revoke API access if misuse is detected.
6. Acceptable Use
You agree not to use our Service for any unlawful, abusive, or prohibited purposes, including but not limited to:
- Hosting content that violates Indian law or the laws of the server's jurisdiction
- Sending spam, phishing emails, or malicious communications
- Conducting DDoS attacks or other network abuse
- Hosting malware, viruses, or exploitative software
- Mining cryptocurrency without prior written approval
- Copyright infringement or intellectual property violations
- Hosting child exploitation material (zero tolerance)
- Any activity that disrupts or degrades the Service for other users

7. Server Provisioning & Management
- Servers are provisioned on a best-effort basis, typically within 30 seconds of API request.
- We do not guarantee specific hardware specifications unless explicitly stated.
- Server deletion via API is irreversible. All data on the server will be permanently destroyed.
- You are solely responsible for backing up your data.
8. Service Level Agreement (SLA)
We target 99.9% uptime for our infrastructure. Scheduled maintenance windows will be communicated in advance. For complete SLA terms, credits, and exclusions, see our SLA page.
9. Data & Privacy
Your use of the Service is also governed by our Privacy Policy. We collect, process, and store data as described therein. You retain ownership of all data stored on your provisioned servers. We do not access your server data except when required by law or to maintain platform security.
10. Limitation of Liability
- The Service is provided "as is" and "as available" without warranties of any kind.
- We shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
- Our total liability for any claim shall not exceed the amount paid by you in the 3 months preceding the claim.
- We are not responsible for data loss on your servers due to your actions, third-party attacks, or events beyond our reasonable control.
11. Indemnification
You agree to indemnify and hold harmless AlgoDelta Solutions Private Limited, its directors, officers, and employees from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.
12. Termination
- You may terminate your account at any time by contacting support or through the dashboard.
- We may terminate or suspend your account for violations of these Terms, non-payment, or at our discretion with 30 days' notice.
- Upon termination, all active servers will be destroyed and data permanently deleted after a 7-day grace period.
- Termination does not relieve you of the obligation to pay any outstanding amounts.
13. Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts in Rajkot, Gujarat, India.
14. Changes to Terms
We reserve the right to update these Terms at any time. Changes will be effective upon posting on our website. Continued use of the Service after changes constitutes acceptance of the revised Terms. Material changes will be notified via email or dashboard notification.
